Today, I finally had a chance to review Lee Seham’s letter to the OSHA investigator, Jason Brush. It is superb. Lee is, in my experience, an extraordinarily talented lawyer in dealing with AIR-21 issues. The factual and legal research that was involved in making his arguments was second to none. Lee sets a high bar for practitioners in this area. He did not miss anything so far as I could determine. Please let me know if OSHA makes a probable cause finding in your favor.
